Trials

A trial of the issues will occur when a person pleads not guilty to one or more criminal charges. It is then the responsibility of the Victorian Director of Public Prosecutions (or Police Prosecutor) if your matter is being heard in the Magistrates’ Court) to prove the case against you beyond reasonable doubt.

There are a number of reasons why a person may wish to plead not guilty. They may not have committed the offence, or they may have a full defence to the charge (such as self defence on a charge of murder or assault). They may simply wish to have their day in court and observe the prosecution put to its proof.
