Ordinarily the court will consider the circumstances of the offending and your personal circumstances. Circumstances which may aggravate penalty include repeat offending, the extent of your actions (eg the financial consequence, or the injury caused), whether the offending was committed in breach of a position of trust, premeditation, and many other relevant factors.

Other circumstances which may mitigate penalty include an early plea of guilty, remorse, cooperation with authorities, rehabilitation, lack of prior criminal history, youth, and many others.
