Yes, this is a fundamental right even if there is an overwhelming case against you. You may wish to plead not guilty because you didn’t commit the offence charged, or because you have a defence at law. You may simply wish to put the prosecution to its proof. We will discuss the advantages and disadvantages of pleading guilty and not guilty once we have received your instructions and considered the prosecution case against you.
It is important to note that if you are seeking funding from Legal Aid, there must be “merit” in a defence in order for financial assistance to be granted. These limitations do not apply where you are paying privately for your legal representation.
