This successful appeal arose in circumstances in which the Appellant convicted of murdering Assistant Commissioner of Australian Federal Police. A judicial inquiry into the guilt of the Appellant had been ordered, and the Respondent had challenged the inquiry suggesting that fitness to plead did not raise question or doubt as to guilt of Appellant.
